These Terms of Service (“Terms”) govern your use of www.adriapulse.org and any purchase made through our online store. By placing an order, you agree to these Terms in full. These Terms are prepared in accordance with Montenegro’s Law on Consumer Protection (Zakon o zaštiti potrošača), Montenegro’s Law on Electronic Commerce (Zakon o elektronskoj trgovini), Montenegro’s Law on Internal Trade (Zakon o unutrašnjoj trgovini), and EU Directive 2011/83/EU on consumer rights.

1. General Terms of Use

By accessing and using this website, you confirm that you are at least 18 years of age or have the consent of a parent or guardian. You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others.

2. Products & Availability

All products are subject to availability. We reserve the right to discontinue any product at any time. Product images are for illustrative purposes; slight variations in color or appearance may occur due to screen settings or manufacturing differences.

3. Pricing, VAT & Payment

All prices are displayed in USD and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without notice. Payment must be completed at the time of order. We accept the payment methods displayed at checkout.

VAT / PDV Notice: AdriaPulse D.O.O. operates under Montenegro’s Law on Value Added Tax (Zakon o porezu na dodatu vrijednost). The mandatory VAT (PDV) registration threshold in Montenegro is 30,000 EUR annual turnover. Where goods are shipped directly between third countries without entering Montenegrin customs territory, such transactions are treated as export / international trade and are generally subject to a 0% VAT rate under Montenegrin law. Buyers are responsible for any import duties or local taxes applicable in their destination country.

4. Order Confirmation & Invoicing

After placing an order, you will receive an email confirmation. This confirmation constitutes a binding distance sales contract between you and AdriaPulse D.O.O. We reserve the right to cancel orders in cases of pricing errors, stock unavailability, or suspected fraud, with a full refund issued promptly.

In accordance with Montenegro’s Law on Internal Trade (Zakon o unutrašnjoj trgovini), AdriaPulse D.O.O. is obligated to issue a sales document (invoice / račun) for every transaction. Your order confirmation email serves as your sales document. A formal invoice will be issued upon request — please contact us at adriapulse@outlook.com.

5. Delivery & Shipping

In accordance with Montenegro’s Law on Consumer Protection (Zakon o zaštiti potrošača), unless otherwise agreed in writing, AdriaPulse D.O.O. will deliver your order within a maximum of 30 days from the date of order confirmation. If delivery cannot be completed within this period, you will be notified promptly and offered the option to cancel your order for a full refund.

Estimated delivery times are displayed on product pages and at checkout. These are estimates and may vary due to customs processing, carrier delays, or other factors outside our control. Free shipping is available to the United States and EU countries on qualifying orders.

6. Warranty & Guarantee Conditions

AdriaPulse D.O.O. provides the following warranty and guarantee terms in accordance with Montenegro’s Law on Consumer Protection and EU Directive 1999/44/EC on consumer goods and guarantees.

6.1 Legal Conformity Guarantee

All products sold through our store must conform to the description provided and be fit for their intended purpose. If a product is found to be defective or non-conforming at the time of delivery, you are entitled to:

  • Repair or replacement of the defective product, free of charge;
  • A proportionate price reduction if repair or replacement is not possible;
  • A full refund if the defect is significant and cannot be remedied.

The legal conformity guarantee period is 2 years from the date of delivery, as required by Montenegrin consumer law.

6.2 Defective or Incorrect Items

If you receive a defective, damaged, or incorrect item, please contact us within 14 days of delivery at adriapulse@outlook.com. We will arrange a replacement or full refund, including return shipping costs, at no charge to you.

6.3 Commercial Guarantee (Where Applicable)

Some products may carry an additional commercial guarantee provided by the manufacturer or supplier. Where such a guarantee exists, its terms will be stated on the product page. A commercial guarantee does not affect your statutory rights under the legal conformity guarantee.

6.4 Exclusions

The warranty does not cover damage caused by:

  • Misuse, negligence, or accidental damage by the customer;
  • Normal wear and tear;
  • Unauthorized modifications or repairs;
  • Damage occurring after delivery due to external causes.

7. Marketing Communications & Opt-Out Right

In accordance with Montenegro’s Law on Electronic Commerce (Zakon o elektronskoj trgovini) and the EU ePrivacy Directive, AdriaPulse D.O.O. complies with the following rules on commercial electronic communications.

7.1 Identification of Commercial Communications

Any marketing or promotional email sent by AdriaPulse D.O.O. will be clearly and unambiguously identified as a commercial communication (advertisement) in the subject line or header. We will never send marketing emails disguised as transactional or personal messages.

7.2 Consent & Opt-In

We will only send marketing communications to individuals who have explicitly consented to receive them (opt-in). Consent is obtained at the time of account registration, checkout, or newsletter subscription, and is always voluntary.

7.3 Your Right to Opt-Out

You have the unconditional right to withdraw your consent and opt out of marketing communications at any time, free of charge and without providing a reason, by:

  • Clicking the “Unsubscribe” link included at the bottom of every marketing email;
  • Sending an email to adriapulse@outlook.com with the subject line “Unsubscribe”;
  • Contacting us via our Contact Page.

Opt-out requests will be processed within 5 business days. After opting out, you will no longer receive marketing emails, but will continue to receive transactional emails (order confirmations, shipping updates) necessary to fulfill your order.

7.4 No Spam Policy

AdriaPulse D.O.O. strictly prohibits the sending of unsolicited commercial emails (spam). All marketing communications comply with applicable anti-spam legislation, including the Montenegrin Law on Electronic Commerce and the EU ePrivacy Directive.

8. Dispute Resolution

AdriaPulse D.O.O. is committed to resolving any disputes fairly and efficiently. We encourage customers to contact us first before initiating formal proceedings.

8.1 First Step: Contact Us

We aim to respond to all complaints within 5 business days and resolve disputes within 30 days.

8.2 Out-of-Court Resolution (ODR)

If we are unable to resolve your complaint directly, EU consumers have the right to use the European Online Dispute Resolution (ODR) platform:

8.3 Montenegrin Consumer Protection Authority

Consumers in Montenegro may also submit complaints to:

  • Administration for Inspection Affairs (Uprava za inspekcijske poslove) — consumer protection enforcement;
  • Consumer Protection Organisation of Montenegro — mediation and advisory services.

8.4 Governing Law & Jurisdiction

These Terms are governed by the laws of Montenegro. The competent courts of Budva, Montenegro shall have jurisdiction, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.

9. Intellectual Property

All content on this website — including text, images, logos, and design — is the property of AdriaPulse D.O.O. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, AdriaPulse D.O.O. shall not be liable for any indirect, incidental, or consequential damages arising from your use of this website or products purchased, except where such liability cannot be excluded under applicable consumer protection law.

11. Amendments

We reserve the right to update these Terms at any time. Changes will be published on this page with an updated effective date. Continued use of the website after changes constitutes acceptance of the revised Terms.
